Welcome to the Pirates Property Owners Association (PPOA)! We're located on the West End of Galveston Island, Texas, where our neighborhoods enjoy the scenic beauty of coastal living as well as the advantages of a major metropolitan area. Galveston is about 45 miles south of Houston on Interstate 45. 
Our Pirates communities are made up of 1,700 homes: Pirates Beach, Pirates Beach West, and Pirates Landing Townhomes are adjacent to the Gulf of Mexico while Pirates Cove, Laffite's Cove, The Enclave of Pirates Cove, and The Villas are on, or close to, Galveston Bay. Residents enjoy endless recreational opportunities such as fishing, boating, kayaking, birding, golfing, surfing, cycling, or just strolling along the beach. Community amenities include a members-only Country Club and Golf Course.
Our neighborhoods are known for their paradise-like rest and relaxation atmosphere and include both full and part-time residents. In addition to the beach and bay, we are surrounded by the Artist Boat Coastal Heritage Preserve, Galveston Island State Park, and Laffite's Cove Nature Preserve, all of which are among the Island’s most beautiful natural resources.

Update on Short Term Rentals

Hello Neighbors-
We received a ton of feedback and questions from the Community after we posted the ruling last week from 56th District Court Judge Lonnie Cox supporting the PPOA’s ability to enforce the Pirates Cove Short Term Rental Deed Restriction Amendments.
Thanks to all of you that commented and I think we were able to answer every question personally.  Because we received so many different questions, I thought it was important to send this update to the Community.
The three most frequent questions were:
Are short term rentals allowed at Pirates Beach and Pirates Beach West?  Answer is yes.
Does this STR ruling apply to all Pirates Cove Sections?  Yes, except for Pirates Cove Section 7 - The Enclave.
Does this ruling apply to Laffites Cove and the Enclave?  No, they were not a party to the lawsuit.  However, they have their own deed restriction amendments (completed several years earlier) limiting short term rentals to no less than 90 consecutive days.
To sort out this short term rental situation between all of the PPOA Sections, we have created a list of PPOA Sections that allow Short Term Rentals (STR) and those that don’t allow Short Term Rentals. Please click on this link STR LIST to see the status for all PPOA Sections.
Several questions from property owners asked, “What happened?” For those that are new to the Community here is the history lesson.
In 2015, Laffites Cove property owners passed a Deed Restriction Amendment limiting short term rentals to no less than 90 consecutive days.  A few years later, the Villas property owners approved the same amendment for their Section.
In 2020, property owners in several Pirates Cove Sections desired to amend their deed restrictions as well.  These Pirates Cove Sections were:
Pirates Cove Sections 1 & 2
Pirates Cove Section 3, 4, and 5
Several property owners in these sections created a deed restriction amendment limiting short term rentals and were successful in convincing a majority of the property owners in their respective Sections to approve the Amendment.  The Amendments that limited short term rentals to no less than 90 consecutive days was filed at the Galveston County Courthouse and presented to the PPOA to begin enforcement of the new Deed Restriction amendments.  The PPOA enforcement activity was soon challenged by 5 Pirates Cove property owners that wanted to continue their rental activities.  A lawsuit was filed by these 5 plaintiffs against the PPOA to prevent the PPOA from enforcing the new STR Amendments.  The PPOA’s D&O Insurance policy provided legal counsel and ultimately obtained a ruling from the 56th Galveston County District Court in favor of the PPOA on May 16, 2022.  At this point, all short term rentals in the applicable Pirates Cove Sections should cease.
Over the last few days, we have received numerous reports that not all renting property owners in the subject Pirates Cove Sections have stopped renting.  The Court is aware of this fact.
An appeal by the Plaintiffs is possible and further details will be made available as they occur.

Elections Postponed

Hello Neighbors-
Over the years the PPOA Annual Members Meeting has typically been held in June, but per the PPOA Bylaws the PPOA Board has the ability to choose alternative dates. The PPOA Board met yesterday and unanimously agreed to change the date of the PPOA Annual Members Meeting to:
Date:     Saturday July 9, 2022
Time:     9:00am
Place:    Galveston Country Club
A Zoom option will be available for those unable to attend in person.
You will receive a new Election Package in the first week of June 2022 that will contain the following:
Annual Members Meeting Notice for July 9, 2022
A New July Election Ballot
Bio’s of all Candidates
Additionally, a copy of the REVISED Annual Members Meeting Notice, July Election Ballot, and all Candidate Bio’s will be added to the website in the next few days. 
This change to the Annual Members Meeting Date is due to several Election Packet mail problems experienced by our management company CKM. The first mail-out was sent to all property owner's physical Galveston addresses. The mail-out should have been sent to all property owner's mailing addresses.  A second mail-out was attempted, however one of the Bio’s was inadvertently left out of the second Election Packet. It is possible that you have received two Election Packets, one Election Packet, or none.
Bruce Deckard, CKM President, has accepted full responsibility for these two errors and his apology letter will be included in the new Election Packet you will receive.
Because of the need to send revised Election Packets to the remainder of the Community and the time it would take to accomplish the project, the Board decided it was in the best interest of the Community to reset the Election Process with all new Election Packets and a new meeting date on July 9, 2022.
Please discard any June 11, 2022 Election Ballots you have received as they are no longer valid.  New Election Ballots will be delivered in the near future.
We apologize for any inconvenience this has caused and look forward to seeing everyone at the Annual Members Meeting on July 9, 2022.
ADDITIONALLY, we are going to hold a regular in-person PPOA Board Meeting on June 11, 2022, at the Galveston Country Club to have a PPOA Candidates Forum where a fuller discussion of important topics can be held.  An official meeting announcement for the June 11, 2022 Board meeting will be forthcoming.

Logo Contest Winners

Thank you to all of you who participated in the logo contest for the PPOA. The contest was in response to the recommendations from our Communications Task Force to update the PPOA logo and use it consistently in all PPOA communications.

We received 27 great submissions and the winner is Robin Collins!
Congratulations to Petra Selever and Emily Swindler for their second and third place submissions.
All three finalists won a $100 gift card courtesy of the PPOA.
Short Term Rental Lawsuit Resolution

Our counsel has forwarded Judge Cox’s Final Judgment in this case; it is attached here. The Judgment grants a Permanent Injunction again the Plaintiffs, who were all of the homeowners engaging in short-term rentals (STR) that were known to us when the case was filed in 2020. The Injunction immediately forbids STR’s, which violate the amended deed restrictions, and the Judgment also awards attorneys’ fees to PPOA. 
The Plaintiffs obviously have the right to appeal, but they have no right to continue STR’s during the appellate process unless they post a supersedeas bond, which I think would be measured by the amount of revenue the Plaintiffs would receive if they rented their properties. Otherwise, short-term renting must end immediately. 
Anyone who sees that STR’s are continuing, anywhere in the community, should send details (dates and addresses) to me (doug@douglasrlittle.com) or to Lee Slataper (leeslataper@att.net). If this happens, our counsel will seek a contempt ruling and damages from the Court. This applies to all sections of Pirates Cove.
